Driver In Fatal Castro Valley Accident Won't Be Charged

June 29 (BCN) -- A prosecutor said Monday that he had good reason to not
file charges against the driver of the car in which 18-year-old Michelle
Dickerson was riding when she was killed in Castro Valley last week.

Alameda County Assistant District Attorney Tom Rogers said Juan Pedroza, a
21-year-old Oakland man who was driving a 1995 Chevrolet Cavalier, had been
hit by Laura Medina, who was driving a 1991 Buick Park Avenue, 12 times and
was traveling at up to 120 mph to save his own skin.

Medina, a 21-year-old Oakland woman, has been charged with one count of
murder and three counts of assault with a deadly weapon in connection with
the June 22 accident that claimed Dickerson's life.

Authorities allege that Medina chased the Chevrolet for 10 miles because she
spotted her boyfriend, 23-year-old Hector Hernandez Rodriguez of Oakland, in
it with Dickerson at a McDonald's restaurant in Oakland.

Medina's lawyer, Frederick Remer, said after Medina was arraigned Friday
that the most Medina should face is vehicular manslaughter and that Pedroza
should be charged with vehicular manslaughter because he believes Pedroza
was driving recklessly.

But Rogers said Medina was tailing Pedroza so closely as their two cars
raced from Oakland to Castro Valley on Interstate Highway 580 that a witness
thought Pedroza was towing her car.

Pedroza couldn't get away from Medina because her car was more powerful,
with six cylinders to his car's four, according to the prosecutor.

The three female passengers in Medina's car were afraid, begged Medina to
stop and said she changed lanes 20 times while they were on the freeway, the
prosecutor said.

According to law enforcement reports filed in court, Dickerson was killed
when the Chevrolet went out of control and crashed into a parked van after
Medina bumped it at about 45 mph on city streets.

Rogers said he charged Medina with murder because her actions were so
dangerous that they created a good chance that someone might die -- and
someone did die -- even though Medina might not have had a specific intent
to kill anyone.

Medina is scheduled to return to Alameda County Superior Court in Hayward
Wednesday.
